Introduction and Acceptance

These Terms and Conditions govern all sales of framed mixed media artworks ("Artworks") by MFI Art to the customer. By placing an order with us, the customer agree to be bound by these Terms.

 Order Process and Contract Formation

·       Order as Offer: When you place an order, you are making an offer to purchase Artworks subject to these Terms.

·       Acknowledgment vs. Acceptance: An order acknowledgment email confirms receipt but does not constitute acceptance. Your order is only accepted by us, and a binding contract formed, when we dispatch your Artworks.

·       Right to Refuse: We reserve the right to refuse or cancel any order at our discretion, including due to product unavailability, pricing errors, payment authorization failure, or suspected fraud.

·       Customer Representations: By ordering, you confirm that you are at least 18 years old, have provided accurate information, and have the legal right to use the selected payment method.

Artwork Description and Variations

·       Accuracy of Images: We take reasonable precautions to ensure product images and descriptions are accurate. However, due to differences in artwork structures and the handcrafted nature of many Artworks, we do not guarantee that colors, textures, and finishes will be exactly as displayed.

·       Handcrafted Variations: Many framed Artworks are handcrafted, making them unique. You acknowledge that there may be reasonable variations in paint color, composition, and exact dimensions.

·       Approximate Measurements: Artwork measurements are approximate and may have a reasonable variance (e.g., up to 1-2 cm) from the quoted size.

·       Customer Responsibility: It is your responsibility to ensure the Artwork is suitable for your needs. We recommend ordering a sample or contacting us if you are unsure.

Pricing and Payment

·       Pricing: All prices are as stated at the time of your order and are subject to change without notice. Prices typically include applicable taxes but exclude delivery charges.

·       Payment: Full payment is required at the time of order. We accept major credit cards and other payment methods as displayed at checkout.

·       Price Errors: If we identify a pricing error, we will notify you and give you the option to proceed at the corrected price or cancel your order for a full refund.

·       Retention of Title: Ownership of the Artwork only passes to you once full payment has been received and cleared.

Shipping, Delivery, and Risk

·       Shipping Costs and Times: Delivery costs are calculated at checkout. Any delivery timeframes provided are estimates only and not guaranteed. Delays can occur due to carrier issues, order volume, or other factors outside our control.

·       Risk of Loss: The risk of loss or damage to the Artwork passes to you as soon as the order is handed over to our carrier.

·       International Shipping: For international orders, you are solely responsible for any customs duties, import taxes, or local fees charged by the destination country.

Damaged Items and Returns

·       Reporting Damage: You must inspect the Artwork immediately upon delivery. Any damage must be reported to us in writing within a specified timeframe (e.g., 48 hours to 30 days), accompanied by clear photos of the damage and the packaging.

·       Remedy for Damage: Upon verification of a valid damage claim, we will offer a replacement or a full refund.

·       Returns for Change of Mind: Due to the unique and often made-to-order nature of framed art, we generally do not accept returns for change of mind. If returns are accepted, the buyer is typically responsible for return shipping costs. Some sellers may offer a statutory 14-day right of withdrawal for certain non-custom items.

·       Lost Shipments: If a carrier confirms a shipment is lost, we will offer a replacement or a refund for the item and original shipping costs.

Intellectual Property

·       Copyright Ownership: All images, artwork, and designs on our website and in the Artworks, themselves are owned by us or our licensors and are protected by copyright laws. The copyright remains with the artist.

·       License to Use Images: By purchasing an Artwork, you acquire the physical item but do not acquire any rights to reproduce or commercially exploit the image or design.

·       Prohibited Uses: You may not reproduce, distribute, or create derivative works from our Artworks without our express written permission.

Limitation of Liability

·       "As Is" Basis: To the fullest extent permitted by law, our Artworks and services are provided "as is.

·       Limitation of Damages: We shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or website.

·       Cap on Liability: Our total liability for any claim related to an Artwork shall not exceed the amount you paid for that specific Artwork.

Governing Law and Disputes

·       Governing Law: These Terms shall be governed by the laws of Arizona without regard to its conflict of law principles.

·       Dispute Resolution: Any disputes arising from these Terms or a sale shall be resolved exclusively in the courts located in Chandler, Arizona.

General Provisions

·       Entire Agreement: These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and us.

·       Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

·       Amendments: We reserve the right to update or modify these Terms at any time by posting the revised version on our website. Your continued use of the site after such changes constitutes your acceptance of the new Terms.
